THE Waigani National Court has stopped the National Executive Council’s (NEC) decision to appoint a new Department of Higher Education, Science, Research and Technology (DHESRT) secretary while suspended secretary Fr Jan Czuba is appealing his revocation in court. Deputy Chief Justice Ambeng Kanadakasi said new appointments should not be made when someone got suspended from the position and the matter against that person was still pending in court. “No one should progress to make a decision on appointing new DHERST secretary accepting the fact that Government parties involved in the case are caught up in the proceeding,” he said. State lawyer Kevin Kipong from the Solicitor General’s Office argued that the decision was made because someone needed to occupy the position for the time being.
Justice Kandakasi said: “Reinstatement is not possible if a new appointment is made but if there is vacancy, reinstatement is in order depending on the court’s decision on Fr Jan’s appeal. “The only thing that makes judicial review attractive for people in the public service is the ability to come for judicial review and have them reinstated.” Czuba through his lawyer Edward Sassigian made the application following the National Court’s decision on May 4 granting him leave to challenge his revocation as the DHERST secretary by NEC on March 21. Czuba further sought court order to restrict the Personal Management Department from conducting any recruitment procedures for appointing new DHERST secretary and to be paid his salaries and was granted. Czuba was suspended for criminal allegations in relation to online applications and selection system. The proceeding was dismissed by the National Court on Jan 19.
