A university certificate issued to the Institute of Business Studies by the Department Higher Education, Research, Science and technology, on earlier orders of the court will now be of no effect.
The certificate was issued yesterday “under protest” by DHERST secretary Fr Jan Zcuba to IBS, subject to the case IBS filed. It was issued in compliance with orders of 4 January by the National Court. That certificate is now of no effect says Minister Pila Niningi today, after the court dismissed the entire proceeding. Justice Hitelai Polume Kiele dismissed the case and discharged the ex-parte orders of January 4 because the proceeding was not properly before court. A motion filed by IBS seeking contempt charges against Fr Jan for alleged non-compliance of the 4 January orders are also dismissed today. The correct party to file the case is IBS as an institute of Higher education and not IBSuniversity, which was incorporated after the NEC decision. On 1 December 2016, the NEC gave approval for the establishment of IBS institute as a university. On 25 January 2017, it begun operating as a university pending that university registration certificate. Fr Jan asked for a review of that gazette notice in November last year on the basis IBS did not comply with requirements under the Higher Education (General Provisions) Act 2014. As a result, IBS obtained a mandatory order on 4 January compelling Fr Jan to register IBS as a university in compliance with the NEC decision. His refusal was based on non-compliance by IBS to apply for university status, which includes details of programs offered, its assets and facilities among others. Meanwhile pending the outcome of a review of the NEC decision, Minister for Higher Education, Pila Niningi, has welcomed IBS to go back and commence the registration process. “There are a lot of universities popping up, not following the requirement stipulated by the law, claiming to be a university and collecting money, so this has to stop”.
