The question on the continuation of temporary orders allowing the Institute of Business Studies to operate as a university will be determined on Friday.
The matter returned to the Waigani National Court last Friday and was adjourned to January 26 after IBS lawyer Wailyo Mapiso objected to an amended notice of motion seeking dismissal of the proceeding. The motion was filed by Nicholas Tame lawyer for the defendants, the Department of Higher Education, Research, Science, and Technology, its acting secretary Father Jan Czuba , and the State . “There is no provision in the National Court rules for parties to file and serve amended notice of motion,” Mr Mapiso submitted. Arguments on this contested motion will be heard on the return date with any further motion seeking dismissal of the proceeding. In the meantime, the January 4 temporary orders among other directives that maintained the status quo at IBS to operate as university has been extended to the return date. Until then, Fr Czuba and his agents were also restrained from taking any further administrative steps under the Higher Education Act to cause delay in registration of students and interfere with the administration and operation of IBS. Fr Czuba has also been ordered to co-operate with IBS administration to allow the smooth start of the 2018 academic year as well. Post Courier
